Comprehensive Policy/Legislation Review
The WSIB develops and creates operational policies in accordance with the Workplace Safety & Insurance Act (WSIA) and its various regulations. These policies guide WSIB decision-makers in determining entitlement to benefits and/or services for injured workers and to the survivors of deceased workers, These policies also provide specific information about workers’ and employers’ rights and obligations, employers’ premiums and other workplace safety & insurance matters.
Ms. Mitoma understands the intent and meaning behind WSIB policies and has a clear understanding of how they are to be interpreted and applied correctly to your case. Ms. Mitoma has an excellent understanding of the WSIA and its regulations and is able to interpret general provisions especially where the WSIA may be silent on such matters.
Comprehensive Case Management Review
Each case is unique and is, therefore, adjudicated based on its own individual merits. There are many components to a case and all are of equal importance and a critical/integral part in completing the whole picture, which is your story. Your story is comprised of the accident history, reporting details, medical/clinical advice and recommended treatment plans, return to work assessments and loss of earnings benefits.
Ms. Mitoma understands all of these components and will identify if there is an entitlement component that should be addressed such as a Non-Economic Loss Benefit, Permanent Disability Award, Survivors’ Benefits, Loss of Retirement Income, Independent Living Allowance, Personal Care Allowances, Home Modifications etc.
From Claims Inception to Appeals at the WSIB/WSIAT
Ms. Mitoma can assist you in establishing a claim with the WSIB by:
completing the required forms,
answering enquiries on your behalf,
ensuring the necessary information is provided to the WSIB so that they make the right initial entitlement decision(s),
that payments of benefits are issued promptly and accurately,
that the decision-maker at the WSIB appropriately monitors your level of impairment and functional abilities so that return to work opportunities happen at the appropriate time,
that clinical information is properly evaluated by the WSIB, and
that the WSIB properly evaluates your level of fitness to return to work.
If your case is denied, Ms. Mitoma will represent your interests/appeal at the WSIB’s Appeals Services Division or at the Workplace Safety & Insurance Appeals Tribunal.
Mediation and Alternate Dispute Resolution
Ms. Mitoma has a background in mediation and has her certification in Alternate Dispute Resolution. She is skilled in mitigating problems that lead to workplace conflict such as returning to work to a safe and suitable occupation that is within your functional abilities. She understands the re-employment obligations of the employer and the co-operation obligations of the workplace parties. She will assist you in achieving your goal(s) by remaining focused on your rights, needs and interests to obtain the best optimal solution/remedy for you.
Commissioner of Oath/Notary Public
Ms. Mitoma is a Commissioner of Oath and Notary Public.
As a Commissioner of Oath, Ms. Mitoma can administer and witness the swearing of oaths or solemn affirmations in the taking of an affidavit for legal documents. Ms. Mitoma will witness your signature when you affirm/swear that the contents of a document are true and will affix her seal/stamp to this document.
As a Notary Public Ms. Mitoma can notarize legal documents requiring a notary signature and seal including but not limited to:
. consent to travel documents
. certification of original documents
. gifting of vehicle to family members
. passports
. certification of photographs and documents supporting identity.
